Terms of Use
1. Who we are and what this is
Nerdies ("nerdies", "we", "us") is an app where people share what they're into, with the stats to prove it. It is provided by:
Contact: the contact address we will publish before launch
By creating an account or using Nerdies, you agree to these Terms and to our [Privacy Policy](privacy-policy.md) and [Community Guidelines](community-guidelines.md). If you don't agree, please don't use Nerdies.
If you downloaded Nerdies from the Apple App Store, Apple's standard Licensed Application End User License Agreement also applies. If these Terms conflict with it, Apple's terms win on the points they cover.
2. Who can use Nerdies
- You must be at least 13 years old.
-
- You must have the legal capacity to accept these Terms, or your parent or guardian must accept them for you.
- You can't use Nerdies if we removed your account for breaking these Terms, unless we say yes in writing.
3. Your account
- Sign in with Apple, Google, or email. Email sign-in uses a one-time 6-digit code.
- Give us accurate information and keep your sign-in method secure. You are responsible for what happens under your account.
- Pick a username that isn't misleading and doesn't pretend to be someone else, or to be Nerdies or its staff. We keep some names reserved.
- One person, one account. Don't sell, rent or hand over your account.
- Tell us at the contact address we will publish before launch if you think someone else got into your account.
- You can delete your account in the app any time (Settings, then Delete account).
4. Your content, and the license you give us
You keep ownership. What you post on Nerdies stays yours: your photos, text, stats, projects, comments. We don't claim ownership.
Our license. To run Nerdies, you give us a worldwide, non-exclusive, royalty-free license to host, store, copy, resize, crop, reformat, display, and distribute your content inside Nerdies, and to make and show share cards that are built from your content (for example, an image with your photo and stats that you choose to share to Instagram Stories or another app). The license covers only what is needed to operate and promote nerdies's features for you and the people you let see your content. We don't use your content in ads for third-party products, and we don't sell it.
How long. The license ends when you delete the content or your account, except for (a) copies kept briefly in backups, (b) content that other people already shared, and (c) copies we must keep to follow the law.
Your promises about your content. You promise that:
- you own it, or you have the right to post it;
- it doesn't break any law or anyone's rights (copyright, privacy, trademark);
- the people in your photos agree to be there, where the law or common sense says they should;
- the stats you enter are honest. Fake stats ruin the point of the place.
Projects and credit. When you list someone as a team member or give credit, make sure it is true. If you are a project owner, you decide who can edit it. Deleting your account deletes the projects you own.
What other people post. Other users' content belongs to them. You can't copy, scrape or reuse it outside Nerdies without their permission.
5. Acceptable use
Follow the [Community Guidelines](community-guidelines.md). In short, you may not:
- post content that is illegal, hateful, harassing, threatening, violent, sexually explicit, or that shows nudity;
- post content that sexualizes or endangers minors. We report this to the authorities;
- bully, stalk, dox, or impersonate anyone;
- post spam, scams, malware, or phishing links;
- post fake stats to trick people, or create fake accounts or engagement;
- upload content that infringes someone else's rights;
- try to break, overload, scrape, reverse-engineer, or get around the security of Nerdies, or access data that isn't yours;
- use Nerdies for anything illegal, or to promote illegal activity.
6. Zero tolerance for objectionable content and abuse
There is no place on Nerdies for objectionable content or abusive users. This means content that is illegal, hateful, harassing, sexually explicit, graphically violent, or that otherwise breaks section 5 or the Community Guidelines.
We provide these tools:
- Report. You can report any NerdStats, Post, comment, or user from inside the app. Add a short reason.
- Block. You can block any user from inside the app. Blocking removes follows in both directions, and you will no longer see each other's content or get Activity from each other.
- Review commitment. We will review reports and act on objectionable content within 24 hours of receiving the report. Acting can mean removing the content, warning the user, or removing the user's account.
- Removal. We may remove content or accounts that break these Terms. We may do this without warning if it is serious.
You can also write to the contact address we will publish before launch to report something or to appeal our decision.
7. Suspension and termination
- By you. Stop using Nerdies at any time, and delete your account in the app.
- By us. We can suspend or close your account, or remove content, if you break these Terms, put others at risk, or if we must by law. When we can, we tell you why and how to appeal. We may skip the warning for serious cases.
- What happens next. When your account ends, your right to use Nerdies ends. Sections that by their nature should survive (for example ownership, disclaimers, liability, governing law) continue to apply.
8. Our service
- Nerdies is free to use for now.
- Nerdies is in early development and features can change, break, or be removed. We try to keep it running but don't promise it will always be available or error-free.
- We may set limits (for example on uploads, sign-in attempts, or sending codes) to keep the service safe.
9. Intellectual property
- The Nerdies name, logo, design, and software belong to. We give you a personal, non-exclusive, non-transferable, revocable license to use the app.
-
- Don't copy or modify our app, and don't use our name or logo in a way that suggests we endorse you.
Copyright complaints. If you believe something on Nerdies infringes your copyright, email the contact address we will publish before launch with: what the work is, where to find the content on Nerdies, your contact details, and a statement that you are the owner or authorized to act for the owner. We will review it and may remove the content.
10. Disclaimers
